Operated by Smith Masilotti LLC ("Ruby Native," "we," "us"). By subscribing to a paid Ruby Native plan or accepting these terms at signup, you ("Customer," "you") agree to this license.
Ruby Native has three parts, and they are licensed differently:
ruby_native gem on RubyGems is licensed under the MIT License. This license does not restrict it, and nothing here limits your rights under MIT."Native source" below means the closed source code, not the gem.
Each subscription covers one application. While you have an active paid subscription, we grant you a non-exclusive, non-transferable, worldwide license to use and modify the native source solely to build and operate the application covered by your subscription, and to use the cloud build service according to your plan.

These restrictions apply only to the native source. They do not apply to the gem.
Plans, prices, and what each one unlocks are described at rubynative.com/pricing. Subscriptions are billed per app and annually through Stripe, and they renew automatically until cancelled, as described in our Terms of Service. Each application requires its own subscription. We provide the native source to you while your subscription is active.
Where a separate order or services agreement includes a first year of a paid plan, such as a Turnkey engagement, that order controls when billing begins, and the plan renews at the then-current rate after the included period.
If your subscription expires or is cancelled:
The native source is our confidential, proprietary information and trade secret. You will keep it confidential, will not disclose it outside your organization, and will protect it with at least reasonable care. This obligation survives termination for as long as the native source remains non-public. The gem is public and is not covered by this section.
We own all right, title, and interest in Ruby Native, including the native source, the cloud build service, and all related intellectual property. You own your own application and the code and configuration you write. Modifying your copy of the native source does not transfer any ownership of the native source to you. We assign you no rights except the license in Section 2.
The native source and the cloud build service are provided "as is," and except as expressly stated we disclaim all warranties, including merchantability and fitness for a particular purpose. We do not guarantee that Apple or Google will approve any app. To the maximum extent allowed by law, our total liability under this license will not exceed the fees you paid us in the twelve months before the claim, and we are not liable for indirect, incidental, or consequential damages.
We may update this license, and the then-current version applies when your subscription renews. This license is governed by the laws of the State of Oregon. Where you also sign a Ruby Native services agreement, this license governs the software and your use of the native source, and the services agreement governs the services, scope, and fees. If the two conflict about the software or the native source, this license controls.
